Well, we have just about had it. I called my aunt, who is a superintendant over another school district, and asked a few questions.. Well, let's just say that I have been educated on how to beat them at their own game. She told me some things to tell them that will make them shake in their boots I am going to call the school sometime tomorrow and make an appointment with the counselor, and talk with her. This is one thing that she told me to be sure and say. "My son is failing, not because he does not try, he is failing because of his disability, and I do not want my son left back, because of his disability." She told me when I start my conversation off with that first, they will figure out really fast that I mean business.. She told me to ask about the "No child left behind". Find out what they do when my child starts failing. What programs they offer, etc... She told me that if he gets held back he will stay in the 5th. grade and will not pass unless he passes this TAKS test. They have it now that if you are in the 3rd. grade and do not pass the test, you will not advance to the 4th. grade. They are going to start doing that with the 5th. graders next year.. So, if my son gets held back he will fall under that category, and their are no modifications for the TAKS test. So, basically if my son gets held back he probably never get out of the 5th. grade!!!

I hope it gets them too!!! My hubby did have it out with them this morning, it got really, really heated!!!! The principal looked at my hubby and told him to get out and my hubby looked at him and said that he didn't have to go anywhere and then asked the principal who pays his salary!!!!! After a few more words and the threaten of a lawyer the principal told my husband to just go and get our lawyer and my husband said I don't have to go and get one, I already have one!!!! The principal asked my husband if he would come back to his office again!!! ;D I think the principal got a little nervous when we "lawyered up" on'em!!!

While there are not actual modifications for the TAKS test there is another test that kids with reading problems can take. My DS is in 7th grade and takes the other test for reading and writing because he is in resource reading classes. (he said they were easy)He also has the math sentence questions read to him. I monitored the Taks test for two years as a teachers aide and sat thru the orentation for the teachers each year. My DD is taking the TAKS test for 5th grade tomorrow, wed, and thurs. DS takes his for 7th grade math this week as well.

I really hate that it came to that yesterday between my husband and the principal. But maybe they will start doing things a little different. They tried to tell us that we are bad parents (not in those words, but in a round about way) My husband told them that we would handle our end, but they better start handling their end.. ;D ;D I loved that!! I told my husband that was good thinking..

OH WAU Way to go, it´s always sad to have to go the hard way, but if that´s only language they´ll understand.... what else is there to do After all, if a parent doesn´stand up for a kid, who does Good going I hope it get´s better! Marja

My aunt just basically just confirmed to me that my concerns were not something to just ignore. That what we were going through with the school is something to definately bring to their attention over and over again, and then she gave me the correct steps in filing a grievance, and she also told me that there is nothing wrong with threatening them with a lawyer. She said that when a child has ADHD and dyslexia they fall under the American's with Disabilities Act (which I knew) and that is nothing to mess with either. And she also said that there is nothing wrong with throwing that into the conversation either.. She said if I have proof that they are not doing what they are supposed to do then there is nothing wrong with pulling out the "Big Guns" Man, do I wish she was the superintendant of this district. I would have some teachers head on a platter, and she told me that if our super was any good he would do the same thing, but I have to file a grievance and since it is close to the end of the school year the only down side to this is that the super could drag his feet, since he has so many days to make a decision and let me know his decision and then if I am not happy with that decision I can take it up with the school board, and then they have so many days to make a decision and let me know what decision they made. In other words, right now is basically too late unless I want to continue this battle at the begining of next year.. She said it is just something to think about. She did say in her opinion that we should just ride the rest of the year out put my son in summer school and get him out of the 5th. grade.
